農業部相關負責人就《農村土地經營權流轉交易市場運行規范(試行)》答記者問

       近日,農業部印發了《農村土地經營權流轉交易市場運行規范(試行)》(以下簡稱《規范》),記者就此采訪了農業部農村經濟體制與經營管理司司長張紅宇。

記者:《規范》的制定背景是什么?

張紅宇:近年(nian)(nian)(nian)來(lai),隨著土(tu)(tu)地(di)(di)(di)經(jing)營(ying)(ying)權(quan)(quan)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)規(gui)(gui)(gui)(gui)模的(de)(de)(de)不斷擴大,已(yi)經(jing)有(you)(you)(you)超(chao)過三分之一的(de)(de)(de)承包土(tu)(tu)地(di)(di)(di)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)出去,每年(nian)(nian)(nian)新增流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)面積4000多(duo)萬畝, 涉及數(shu)以百萬計的(de)(de)(de)承包農(nong)(nong)(nong)戶。因此,建(jian)立健(jian)(jian)全(quan)安(an)全(quan)、有(you)(you)(you)序(xu)(xu)(xu)(xu)的(de)(de)(de)土(tu)(tu)地(di)(di)(di)經(jing)營(ying)(ying)權(quan)(quan)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)交(jiao)易(yi)市(shi)(shi)場,對維護廣(guang)大農(nong)(nong)(nong)民(min)群(qun)眾和(he)新型(xing)經(jing)營(ying)(ying)主體(ti)合(he)法權(quan)(quan)益,促(cu)進適度(du)(du)規(gui)(gui)(gui)(gui)模經(jing)營(ying)(ying)有(you)(you)(you)序(xu)(xu)(xu)(xu)發(fa)展意(yi) 義重(zhong)大。按(an)照(zhao)中(zhong)(zhong)(zhong)(zhong)央(yang)、國(guo)(guo)務院(yuan)(yuan)的(de)(de)(de)部(bu)(bu)(bu)署(shu)要求(qiu),各(ge)地(di)(di)(di)在農(nong)(nong)(nong)業(ye)(ye)部(bu)(bu)(bu)指(zhi)導(dao)下(xia),依托(tuo)經(jing)管(guan)部(bu)(bu)(bu)門(men)(men)(men)不斷健(jian)(jian)全(quan)農(nong)(nong)(nong)村土(tu)(tu)地(di)(di)(di)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)交(jiao)易(yi)市(shi)(shi)場,加(jia)強(qiang)縣(xian)、鄉(xiang)土(tu)(tu)地(di)(di)(di)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)市(shi)(shi)場建(jian)設,為推動土(tu)(tu)地(di)(di)(di)經(jing)營(ying)(ying)權(quan)(quan)有(you)(you)(you) 序(xu)(xu)(xu)(xu)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)發(fa)展農(nong)(nong)(nong)業(ye)(ye)適度(du)(du)規(gui)(gui)(gui)(gui)模經(jing)營(ying)(ying)發(fa)揮(hui)了(le)(le)巨(ju)大作用。截至(zhi)2015年(nian)(nian)(nian)底,已(yi)有(you)(you)(you)1231個縣(xian)(市(shi)(shi))、17826個鄉(xiang)鎮建(jian)立了(le)(le)土(tu)(tu)地(di)(di)(di)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)服務中(zhong)(zhong)(zhong)(zhong)心,覆蓋了(le)(le)全(quan)國(guo)(guo)約43%的(de)(de)(de) 縣(xian)級行政(zheng)區劃單(dan)位,流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)合(he)同(tong)(tong)簽(qian)訂率達到67.8%。但從實踐看,各(ge)地(di)(di)(di)土(tu)(tu)地(di)(di)(di)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)交(jiao)易(yi)市(shi)(shi)場發(fa)展并不均衡(heng),有(you)(you)(you)的(de)(de)(de)運(yun)行時(shi)間較(jiao)長,交(jiao)易(yi)也(ye)比較(jiao)規(gui)(gui)(gui)(gui)范(fan);有(you)(you)(you)的(de)(de)(de)剛剛起步(bu),需 要逐步(bu)建(jian)立健(jian)(jian)全(quan)相應制度(du)(du)。2014年(nian)(nian)(nian),《中(zhong)(zhong)(zhong)(zhong)辦(ban)(ban)國(guo)(guo)辦(ban)(ban)關(guan)于引(yin)導(dao)農(nong)(nong)(nong)村土(tu)(tu)地(di)(di)(di)經(jing)營(ying)(ying)權(quan)(quan)有(you)(you)(you)序(xu)(xu)(xu)(xu)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)發(fa)展農(nong)(nong)(nong)業(ye)(ye)適度(du)(du)規(gui)(gui)(gui)(gui)模經(jing)營(ying)(ying)的(de)(de)(de)意(yi)見》(中(zhong)(zhong)(zhong)(zhong)辦(ban)(ban)發(fa)〔2014〕61號)提(ti)出,要研究 制定流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)市(shi)(shi)場運(yun)行規(gui)(gui)(gui)(gui)范(fan),加(jia)快發(fa)展多(duo)種形(xing)式的(de)(de)(de)土(tu)(tu)地(di)(di)(di)經(jing)營(ying)(ying)權(quan)(quan)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)市(shi)(shi)場,農(nong)(nong)(nong)業(ye)(ye)部(bu)(bu)(bu)也(ye)將這項工(gong)作列入2016年(nian)(nian)(nian)重(zhong)點工(gong)作。今(jin)年(nian)(nian)(nian)以來(lai),我(wo)們在充分調研基礎(chu)上,會(hui)同(tong)(tong)北京農(nong)(nong)(nong) 村產權(quan)(quan)交(jiao)易(yi)所、武漢農(nong)(nong)(nong)村產權(quan)(quan)交(jiao)易(yi)所、山西省土(tu)(tu)地(di)(di)(di)流(liu)轉(zhuan)(zhuan)(zhuan)(zhuan)(zhuan)工(gong)作站、土(tu)(tu)流(liu)網(wang)、土(tu)(tu)地(di)(di)(di)資源網(wang)等相關(guan)單(dan)位起草(cao)了(le)(le)初稿,并征求(qiu)了(le)(le)30個省(除西藏外)省級農(nong)(nong)(nong)村承包土(tu)(tu)地(di)(di)(di)管(guan)理(li) 部(bu)(bu)(bu)門(men)(men)(men),以及中(zhong)(zhong)(zhong)(zhong)央(yang)農(nong)(nong)(nong)辦(ban)(ban)、國(guo)(guo)務院(yuan)(yuan)法制辦(ban)(ban)、中(zhong)(zhong)(zhong)(zhong)國(guo)(guo)人民(min)銀行和(he)國(guo)(guo)家工(gong)商(shang)總局等部(bu)(bu)(bu)門(men)(men)(men)意(yi)見后,經(jing)農(nong)(nong)(nong)業(ye)(ye)部(bu)(bu)(bu)2016年(nian)(nian)(nian)第(di)6次常務會(hui)審議通過,形(xing)成了(le)(le)《規(gui)(gui)(gui)(gui)范(fan)》。

記者:《規范》調整的范圍主要是什么?

張紅宇:農(nong)村土地(di)(di)(di)(di)經(jing)(jing)營(ying)權(quan)流(liu)(liu)轉(zhuan)交(jiao)易(yi)市(shi)(shi)場(chang)是(shi)(shi)(shi)依(yi)照市(shi)(shi)場(chang)規(gui)律(lv),為(wei)交(jiao)易(yi)雙方提供服務的(de)平(ping)臺(tai)。2014年國(guo)務院辦公(gong)廳《關(guan)(guan)于引導(dao)(dao)(dao)農(nong)村產權(quan)流(liu)(liu)轉(zhuan) 交(jiao)易(yi)市(shi)(shi)場(chang)健康(kang)發展(zhan)的(de)意(yi)見(jian)》(國(guo)辦發〔2014〕71號)明確(que)指出,這(zhe)類市(shi)(shi)場(chang)是(shi)(shi)(shi)政府主導(dao)(dao)(dao)、服務“三農(nong)”的(de)非盈利(li)性(xing)機構(gou),可以是(shi)(shi)(shi)事(shi)業(ye)法(fa)人,也可以是(shi)(shi)(shi)企(qi)業(ye)法(fa)人。 實踐中,多(duo)數土地(di)(di)(di)(di)經(jing)(jing)營(ying)權(quan)流(liu)(liu)轉(zhuan)交(jiao)易(yi)市(shi)(shi)場(chang)是(shi)(shi)(shi)依(yi)托農(nong)業(ye)系統經(jing)(jing)營(ying)管理部(bu)門成(cheng)立的(de)事(shi)業(ye)單位或國(guo)有(you)企(qi)業(ye),也有(you)一些是(shi)(shi)(shi)民營(ying)企(qi)業(ye)利(li)用互聯網等手段建立的(de)流(liu)(liu)轉(zhuan)交(jiao)易(yi)平(ping)臺(tai)。據 此,《規(gui)范》定(ding)位為(wei)工作(zuo)(zuo)指導(dao)(dao)(dao)性(xing)文件,而非具有(you)強制力和約束力的(de)部(bu)門規(gui)章,目的(de)是(shi)(shi)(shi)為(wei)各地(di)(di)(di)(di)提供參照文本,各地(di)(di)(di)(di)農(nong)村土地(di)(di)(di)(di)經(jing)(jing)營(ying)權(quan)流(liu)(liu)轉(zhuan)交(jiao)易(yi)市(shi)(shi)場(chang)可在(zai)此基(ji)礎上,根據實 際情況補充完善調(diao)整相關(guan)(guan)內容,進(jin)一步完善相關(guan)(guan)工作(zuo)(zuo)規(gui)則,引導(dao)(dao)(dao)土地(di)(di)(di)(di)經(jing)(jing)營(ying)權(quan)公(gong)開、公(gong)正、規(gui)范流(liu)(liu)轉(zhuan)交(jiao)易(yi)。

記者:《規范》涉及到哪些主體和對象?

張紅宇:《規范》充分吸收了現有(you)的(de)(de)(de)土(tu)(tu)地(di)經(jing)(jing)(jing)營(ying)權(quan)流(liu)(liu)(liu)轉(zhuan)(zhuan)市場交(jiao)易(yi)規程,依照農(nong)村(cun)土(tu)(tu)地(di)經(jing)(jing)(jing)營(ying)權(quan)流(liu)(liu)(liu)轉(zhuan)(zhuan)交(jiao)易(yi)程序制定,主要(yao)(yao)遵循(xun)了“提出申(shen)請-進 場交(jiao)易(yi)-簽訂合(he)同-配套服務”的(de)(de)(de)順序。《規范》提出,交(jiao)易(yi)主體(ti)是農(nong)村(cun)集體(ti)經(jing)(jing)(jing)濟組織、承(cheng)(cheng)包(bao)(bao)農(nong)戶、家(jia)庭(ting)農(nong)場、專業大戶、農(nong)民專業合(he)作社(she)、農(nong)業企業等各類農(nong)業經(jing)(jing)(jing) 營(ying)主體(ti),以(yi)及(ji)具(ju)備農(nong)業生產經(jing)(jing)(jing)營(ying)能力(li)的(de)(de)(de)其他(ta)組織或個人。交(jiao)易(yi)條件應該(gai)是交(jiao)易(yi)標的(de)(de)(de)權(quan)屬(shu)清晰(xi)無爭議,交(jiao)易(yi)雙方具(ju)有(you)流(liu)(liu)(liu)轉(zhuan)(zhuan)交(jiao)易(yi)的(de)(de)(de)真實(shi)意愿,符(fu)合(he)法(fa)(fa)律(lv)法(fa)(fa)規政(zheng)策(ce)和規劃要(yao)(yao) 求。交(jiao)易(yi)品種包(bao)(bao)括以(yi)家(jia)庭(ting)承(cheng)(cheng)包(bao)(bao)方式和其他(ta)承(cheng)(cheng)包(bao)(bao)方式取得(de)的(de)(de)(de)土(tu)(tu)地(di)經(jing)(jing)(jing)營(ying)權(quan),也包(bao)(bao)括集體(ti)經(jing)(jing)(jing)濟組織未發(fa)包(bao)(bao)的(de)(de)(de)土(tu)(tu)地(di)經(jing)(jing)(jing)營(ying)權(quan),以(yi)及(ji)其他(ta)依法(fa)(fa)可(ke)流(liu)(liu)(liu)轉(zhuan)(zhuan)交(jiao)易(yi)的(de)(de)(de)土(tu)(tu)地(di)經(jing)(jing)(jing)營(ying)權(quan)。

記者:實踐中,有些集體土地流轉出現了不公開、不透明,容易導致糾紛等問題,《規范》對此有什么規定?

張紅宇:實(shi)踐中,集體(ti)(ti)對外(wai)流(liu)轉(zhuan)(zhuan)交易(yi)土(tu)地(di)的現象已經數見(jian)不鮮,整村整組流(liu)轉(zhuan)(zhuan)土(tu)地(di)的情(qing)況也有很多。一(yi)方(fang)(fang)(fang)面(mian),集體(ti)(ti)統一(yi)流(liu)轉(zhuan)(zhuan)土(tu)地(di)在提高(gao)議(yi) 價(jia)能力、為農(nong)民(min)(min)爭(zheng)取(qu)更大利(li)益(yi)方(fang)(fang)(fang)面(mian)發(fa)揮了(le)(le)積極(ji)作用,也減少了(le)(le)流(liu)入方(fang)(fang)(fang)的交易(yi)成本,極(ji)大提高(gao)了(le)(le)土(tu)地(di)流(liu)轉(zhuan)(zhuan)交易(yi)的效(xiao)率(lv);另一(yi)方(fang)(fang)(fang)面(mian),集體(ti)(ti)流(liu)轉(zhuan)(zhuan)土(tu)地(di)時(shi),少數基層干部(bu)私相 授受、謀取(qu)私利(li)的現象也有發(fa)生,侵犯了(le)(le)農(nong)民(min)(min)合法土(tu)地(di)權(quan)益(yi),影響了(le)(le)農(nong)村經濟(ji)社會(hui)的和諧穩(wen)定。因此(ci),《規(gui)范(fan)》在流(liu)入方(fang)(fang)(fang)進場(chang)交易(yi)時(shi)特(te)別提出:集體(ti)(ti)在組織統一(yi)流(liu)轉(zhuan)(zhuan) 農(nong)戶通(tong)過家庭承包(bao)方(fang)(fang)(fang)式取(qu)得的經營權(quan)時(shi),要(yao)有書面(mian)委托書;未(wei)發(fa)包(bao)集體(ti)(ti)土(tu)地(di)經營權(quan)流(liu)轉(zhuan)(zhuan)時(shi),要(yao)提供農(nong)村集體(ti)(ti)經濟(ji)組織成員的村民(min)(min)會(hui)議(yi)三分(fen)之二(er)以上成員或者三分(fen)之二(er) 以上村民(min)(min)代表(biao)簽(qian)署同(tong)意流(liu)轉(zhuan)(zhuan)土(tu)地(di)的書面(mian)證(zheng)明。

記者:當前,工商資本租賃農地的現象比較突出,《規范》中對此是否有相關考慮?

張紅宇:近年(nian)來,在(zai)農(nong)(nong)(nong)(nong)(nong)村土(tu)(tu)(tu)(tu)地(di)流(liu)轉(zhuan)中(zhong),工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi)本(ben)下鄉租(zu)(zu)賃(lin)(lin)農(nong)(nong)(nong)(nong)(nong)地(di)呈加(jia)(jia)快發展(zhan)態勢,2015年(nian)流(liu)入(ru)企(qi)業(ye)(ye)(ye)的(de)(de)農(nong)(nong)(nong)(nong)(nong)戶承(cheng)包(bao)地(di)面(mian)(mian)積達到(dao)4600萬 畝,占(zhan)流(liu)轉(zhuan)土(tu)(tu)(tu)(tu)地(di)總面(mian)(mian)積的(de)(de)10.4%。一(yi)方(fang)面(mian)(mian),工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi)本(ben)進(jin)(jin)入(ru)農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye),可以(yi)(yi)帶(dai)來資(zi)(zi)(zi)金、技術(shu)和(he)(he)先(xian)進(jin)(jin)經(jing)(jing)營(ying)(ying)模式,加(jia)(jia)快傳統農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye)改(gai)造和(he)(he)現(xian)代(dai)農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye)建設;但(dan)另一(yi)方(fang)面(mian)(mian),工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi) 本(ben)長時間、大面(mian)(mian)積租(zu)(zu)賃(lin)(lin)農(nong)(nong)(nong)(nong)(nong)地(di),容易擠占(zhan)農(nong)(nong)(nong)(nong)(nong)民(min)就業(ye)(ye)(ye)空間,加(jia)(jia)劇耕地(di)“非(fei)糧化(hua)”“非(fei)農(nong)(nong)(nong)(nong)(nong)化(hua)”傾(qing)向(xiang),存在(zai)不(bu)少風(feng)險隱患。中(zhong)央(yang)對(dui)此高(gao)度(du)重視,強(qiang)調對(dui)工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi)本(ben)租(zu)(zu)賃(lin)(lin)農(nong)(nong)(nong)(nong)(nong)地(di)要(yao)有 嚴格的(de)(de)門檻,租(zu)(zu)賃(lin)(lin)的(de)(de)耕地(di)只能(neng)搞農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye),不(bu)能(neng)改(gai)變用(yong)途,讓農(nong)(nong)(nong)(nong)(nong)民(min)成為(wei)土(tu)(tu)(tu)(tu)地(di)流(liu)轉(zhuan)和(he)(he)規(gui)(gui)模經(jing)(jing)營(ying)(ying)的(de)(de)積極(ji)參與(yu)者和(he)(he)真(zhen)正受益者。2015年(nian),中(zhong)辦發〔2014〕61號(hao)文(wen)件和(he)(he) 農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye)部等(deng)四部門《關于加(jia)(jia)強(qiang)對(dui)工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi)本(ben)租(zu)(zu)賃(lin)(lin)農(nong)(nong)(nong)(nong)(nong)地(di)監管(guan)和(he)(he)風(feng)險防(fang)范的(de)(de)意見》(農(nong)(nong)(nong)(nong)(nong)經(jing)(jing)發〔2015〕3號(hao))提(ti)出,鼓勵各地(di)依法探索建立(li)工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi)本(ben)租(zu)(zu)賃(lin)(lin)農(nong)(nong)(nong)(nong)(nong)地(di)資(zi)(zi)(zi)格審查、項 目(mu)審核制度(du),對(dui)流(liu)入(ru)方(fang)的(de)(de)主體資(zi)(zi)(zi)質、農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye)經(jing)(jing)營(ying)(ying)能(neng)力、經(jing)(jing)營(ying)(ying)項目(mu)、土(tu)(tu)(tu)(tu)地(di)用(yong)途、風(feng)險防(fang)范,以(yi)(yi)及是否符合當地(di)產業(ye)(ye)(ye)布局(ju)和(he)(he)現(xian)代(dai)農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye)發展(zhan)規(gui)(gui)劃等(deng)事項進(jin)(jin)行(xing)審查審核。從去年(nian) 以(yi)(yi)來的(de)(de)運行(xing)情況看,工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi)本(ben)租(zu)(zu)賃(lin)(lin)農(nong)(nong)(nong)(nong)(nong)地(di)出現(xian)的(de)(de)“非(fei)糧化(hua)”,特別是“非(fei)農(nong)(nong)(nong)(nong)(nong)化(hua)”現(xian)象得到(dao)了有效(xiao)遏制。為(wei)了進(jin)(jin)一(yi)步規(gui)(gui)范工(gong)(gong)商(shang)(shang)資(zi)(zi)(zi)本(ben)下鄉行(xing)為(wei),此次(ci)《規(gui)(gui)范》強(qiang)調,流(liu)入(ru)土(tu)(tu)(tu)(tu) 地(di)超過(guo)當地(di)規(gui)(gui)定標準(zhun)(zhun)以(yi)(yi)上的(de)(de),需(xu)提(ti)供農(nong)(nong)(nong)(nong)(nong)業(ye)(ye)(ye)經(jing)(jing)營(ying)(ying)能(neng)力等(deng)證(zheng)明(ming)、項目(mu)可行(xing)性(xing)報告,以(yi)(yi)及有權批準(zhun)(zhun)機構準(zhun)(zhun)予流(liu)轉(zhuan)交易的(de)(de)證(zheng)明(ming),強(qiang)調了土(tu)(tu)(tu)(tu)地(di)流(liu)轉(zhuan)的(de)(de)規(gui)(gui)范化(hua)。

記者:今年有232個縣(市)開展農村土地經營權抵押試點,《規范》對此有哪些考慮?

張紅宇:2015年(nian),全國人大常委會授權(quan)在北(bei)京市(shi)大興區(qu)等(deng)232個試點(dian)(dian)縣(市(shi)、區(qu))開展農(nong)(nong)村土地(di)(di)經營(ying)權(quan)抵押(ya)(ya)試點(dian)(dian)。今年(nian)3月,中國 人民銀行、銀監會、保監會、財(cai)政部、農(nong)(nong)業部等(deng)部委聯合下發了(le)《農(nong)(nong)村承包土地(di)(di)的(de)(de)經營(ying)權(quan)抵押(ya)(ya)貸款試點(dian)(dian)暫行辦法(fa)》(銀發〔2016〕79號),明(ming)確提(ti)出試點(dian)(dian)地(di)(di)區(qu) 要(yao)推進(jin)(jin)建立(li)多級聯網(wang)的(de)(de)農(nong)(nong)村產(chan)權(quan)流轉交(jiao)易(yi)平(ping)臺,建立(li)承包土地(di)(di)的(de)(de)經營(ying)權(quan)抵押(ya)(ya)、流轉、評估和處置的(de)(de)專業化服務機(ji)制(zhi),可以在試點(dian)(dian)地(di)(di)區(qu)政府授權(quan)的(de)(de)農(nong)(nong)村產(chan)權(quan)交(jiao)易(yi)平(ping)臺辦 理經營(ying)權(quan)抵押(ya)(ya)登(deng)(deng)記。為推動農(nong)(nong)村經營(ying)權(quan)抵押(ya)(ya)試點(dian)(dian)工作的(de)(de)順利進(jin)(jin)行,《規(gui)范》第十(shi)九條明(ming)確農(nong)(nong)村土地(di)(di)流轉交(jiao)易(yi)市(shi)場經有(you)權(quan)機(ji)關授權(quan)可以開展土地(di)(di)經營(ying)權(quan)抵押(ya)(ya)登(deng)(deng)記,第二 十(shi)條則就抵押(ya)(ya)登(deng)(deng)記過程中的(de)(de)有(you)關事項提(ti)出了(le)具(ju)體要(yao)求,試點(dian)(dian)地(di)(di)區(qu)可以組織開展相(xiang)關工作。

記者:當前,各地的農村土地產權交易所提供服務內容并不相同,《規范》制定中是否有所考慮?

張紅宇:農(nong)村(cun)土(tu)地(di)(di)經營(ying)權(quan)(quan)(quan)流轉交易(yi)市(shi)場(chang)(chang)主(zhu)要(yao)功能是促(cu)進土(tu)地(di)(di)經營(ying)權(quan)(quan)(quan)交易(yi),主(zhu)要(yao)提供(gong)簽訂(ding)服(fu)務(wu)協議(yi)、流轉信息發布(bu)(bu)公(gong)示、價(jia)格(ge)形成(cheng)、流轉合(he)(he) 同及交易(yi)鑒(jian)證、授權(quan)(quan)(quan)抵押(ya)登記等服(fu)務(wu)。《規(gui)范(fan)》提出(chu):流轉市(shi)場(chang)(chang)要(yao)做(zuo)好信息公(gong)示和(he)(he)發布(bu)(bu),流轉合(he)(he)同訂(ding)立應(ying)參照土(tu)地(di)(di)經營(ying)權(quan)(quan)(quan)流轉交易(yi)合(he)(he)同示范(fan)文本(ben),交易(yi)雙方(fang)(fang)(fang)可以獲得 交易(yi)市(shi)場(chang)(chang)提供(gong)的流轉交易(yi)鑒(jian)證,合(he)(he)同到期后(hou)流入方(fang)(fang)(fang)在同等條件下可優先續(xu)約,交易(yi)市(shi)場(chang)(chang)在交易(yi)完(wan)成(cheng)后(hou)還應(ying)該提供(gong)信息查詢(xun)、檔案管(guan)理(li)和(he)(he)糾紛(fen)調處(chu)等服(fu)務(wu)。實踐中,隨 著交易(yi)雙方(fang)(fang)(fang)對土(tu)地(di)(di)經營(ying)權(quan)(quan)(quan)流轉交易(yi)服(fu)務(wu)的需求(qiu)不(bu)斷提高,交易(yi)市(shi)場(chang)(chang)的服(fu)務(wu)內容也不(bu)斷增加和(he)(he)完(wan)善,《規(gui)范(fan)》提出(chu):應(ying)交易(yi)雙方(fang)(fang)(fang)要(yao)求(qiu),市(shi)場(chang)(chang)可以組織提供(gong)法律咨詢(xun)、資(zi) 產評估(gu)、會計審(shen)計、項目策劃、金融保險等服(fu)務(wu),但(dan)收費標準應(ying)根據相(xiang)關規(gui)定(ding)由當地(di)(di)物(wu)價(jia)部門核定(ding)并予以公(gong)示。同時(shi),為保障農(nong)村(cun)土(tu)地(di)(di)經營(ying)權(quan)(quan)(quan)流轉公(gong)開、公(gong)平、規(gui)范(fan) 運行,市(shi)場(chang)(chang)應(ying)該自覺接受社會公(gong)眾(zhong)的監督和(he)(he)依法接受有關部門的管(guan)理(li)。
